Alcohol, Tort Liability & Dram Shop Considerations

1. Alcohol Consumption by Participants
- Moderate consumption of alcohol is permitted at DrachenFest.
- Participants who are visibly intoxicated will be removed from gameplay and prohibited from participating in battles or plot-driven events.
- Role-playing intoxication is allowed; however, if a referee suspects a participant is actually intoxicated, they may request the participant to momentarily cease role-playing to confirm their sobriety.
2. Sale and Service of Alcohol
- DrachenFest US does not sell or serve alcohol but will implement measures to prevent the accidental supply of alcohol to minors.
- Participants aged 21 and over must wear a wristband marker to indicate their legal drinking status.
- Wristbands may only be issued or removed by authorized staff members or security visibly identified by a ‘referee’ baseball cap.
- At check-in, DrachenFest US will verify the participant's age and issue a wristband accordingly.
3. Liability & Compliance with PA Dram Shop Laws
- DrachenFest US ensures that all alcohol consumption policies comply with Pennsylvania Dram Shop statutes.
- Liability for any alcohol-related injury falls on the individual consuming alcohol, not on DrachenFest US or any entity selling or serving alcohol.
4. Alcohol Restrictions for Staff
- Staff members are prohibited from consuming or holding alcohol while wearing a referee cap.
- Staff must remain sober while on duty and must not exhibit signs of intoxication during their shift.
